  2. This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the Rules and Regulations, Privacy Policy, and Terms of Use for access to or usage of https://www.parbatherbal.com.

The domain name https://www.parbatherbal.com ("Website") is owned and operated by Parbat Herbal ("Company"), having its principal place of business at Plot No-36/U5, Road No.13, BMC School No 03, Shivaji Nagar 2, Govandi, Mumbai, Maharashtra, India – 400043, where such expression shall, unless repugnant to the context, be deemed to include its respective representatives, administrators, employees, directors, officers, agents, and their successors and assigns.
  4. For the purposes of this Policy, wherever the context so requires:
    1. The term "You" / "User" shall mean any legal person or entity accessing or using the services provided on this Website, who is competent to enter into binding contracts as per the provisions of the Indian Contract Act, 1872.
    2. The terms "We", "Us", and "Our" shall mean the Website and/or the Company, as the context so requires.
    3. The terms "Party" and "Parties" shall respectively be used to refer to the User and the Company individually and collectively, as the context so requires.
  5. The headings in this Policy are for organizational purposes only and shall not be used to interpret the provisions contained herein. The headings shall have no legal or contractual value.
  6. Use of the Website is solely governed by this Policy and the Terms of Use of the Website ("Terms", available at https://www.parbatherbal.com), along with any modifications made by the Company from time to time at its sole discretion. The User expressly agrees that the Terms and Policy are co-terminus, and expiry/termination of either shall lead to termination of the other.

2. Authorisation & Brand Protection Policy

Parbat Herbal is exclusively owned and operated by Parbat Herbal. Parbat Herbal ke products, logo, images aur trademarks bina written permission ke use nahi kiye ja sakte. No individual, seller, distributor, reseller, or third party is authorized to use, manufacture, promote, list, advertise, or sell Parbat Herbal products, or to use the Parbat Herbal brand name, trademarks, logos, product images, or any brand-related material, on any online or offline platform — including e-commerce websites and social media — without prior written authorization from the Company. Any unauthorized use or listing will be treated as a violation of company policy and intellectual property rights and may result in legal action and platform complaints without prior notice.

3. Collection of Personal and Other Information

  1. The User expressly agrees that the Company collects and stores personal information provided by the User from time to time on the Website, including but not limited to the User's username, password, email address, name, address, service address, destination, age, date of birth, sex, nationality, browsing history, and any images or other information uploaded/submitted by the User. This information is used to provide services and features tailored to the User's needs and to improve the Website experience. The Company will periodically evaluate the User's personal information to keep it safe, accurate, and up to date. If a User has inadvertently registered incorrect contact details, the Company offers a facility to review and correct such information.     2. Protect the Company's rights or property, or those of its affiliated companies;
    3. Prevent a crime or protect national security; or

7. Third-Party Advertisements / Promotions

The Website may use third-party advertising companies to serve ads to Users. Such companies may use information relating to the User's visits to the Website and other websites to provide customized advertisements. The Website may also contain links to other websites that may collect personally identifiable information. The Company is not responsible for the privacy practices or content of any linked third-party websites, and the User expressly acknowledges that any associated risks are borne entirely by the User.

10. Dispute Resolution and Jurisdiction

It is expressly agreed by the Parties that the formation, interpretation, and performance of this Policy, and any disputes arising herefrom, will be resolved through a two-step Alternate Dispute Resolution ("ADR") mechanism. This Section shall survive even after the termination or expiry of this Policy and/or the Terms.

  1. Mediation: In case of any dispute between the Parties, the Parties will attempt to resolve it amicably amongst themselves, to the mutual satisfaction of both Parties. If the Parties are unable to reach an amicable solution within thirty (30) days of one Party communicating the existence of a dispute to the other, the dispute will proceed to arbitration as detailed below.
  2. Arbitration: If the Parties are unable to amicably resolve a dispute through mediation, the dispute will be referred to a sole arbitrator appointed by Parbat Herbal, whose award shall be final and binding on both Parties. The Parties shall bear their own costs for the proceedings, although the sole arbitrator may, at their discretion, direct either Party to bear the entire cost. The arbitration shall be conducted in English, and the seat of arbitration shall be Mumbai, Maharashtra, India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction over all matters arising out of or in connection with this Policy.
